Some helpful conclusions
While the international media has used the event of the GDPR to spread anxiety, we have noticed during the process of making our customers websites compliant, that it isn´t nearly as alarming as promoted. Please watch the interview with Mr. Christophe Buschmann from the luxemburgish “CNPD – Commission nationale pour la protection des données” for further informations about what small & medium sized businesses have to expect.
Punishments are not that brute
The CNPD clearly distinguishes between corporate structures who earn money from processing data and small businesses who simply collect basic user data in order to perform their service. Small Business owners will not face the 20 million fine and fines are not applied directly. Communications due to a law violation will start with a warning, then a reprimand, then a suspension of data processing, and if you continue to violate the law, then the large fines will hit.
GDPR is not only for websites
GDPR is a general law which gives a legal frame to the usage, storage and processing of personal data of any kind and medium. The rules apply not only for your website but also for digital or analog offline systems or those of third parties.
Who controls GDPR compliance
The GDPR compliance is controled by the CNPD. The commission for data pretection will act in case of a “accusation”. This means, users who feel that their personal data was not processed according to the new guidelines, can accuse the business in question at the CNPD. However it is strongly advised to first contact the business itself and ask for the right treatment of the data, before starting any legal processes.
We respect your privacy and will not use your data for any other purpose than contacting you for the appointment creation.
